1. Service Delivery
All services are delivered as described in the applicable service agreement or statement of work. Due to the nature of DevOps consulting and implementation, services are considered delivered upon completion of agreed milestones and handover of deliverables.
2. Refund Eligibility
Refunds may be considered under the following circumstances:
- Non-delivery: If a purchased service has not been commenced within 30 days of payment, you may request a full refund.
- Service not as described: If the delivered service materially differs from the description provided at the time of purchase, you may request a partial or full refund.
- Cancellation before commencement: If you cancel a service before work has begun, you are entitled to a full refund minus any administrative fees (up to 5% of the total amount).
3. Non-Refundable Items
The following are not eligible for refund:
- Services that have been fully delivered and accepted by the client.
- Work completed under a milestone-based payment schedule where the milestone has been achieved.
- Third-party costs incurred on behalf of the client (hosting fees, software licenses, API costs).
- Changes in scope requested by the client after project commencement.
4. Refund Process
To request a refund, contact us at [email protected] with your order details and reason for the refund request. We will review your request within 10 business days and respond with a resolution. Approved refunds will be processed within 14 business days using the original payment method.
5. Dispute Resolution
If you are dissatisfied with our refund decision, you may escalate the matter by contacting us in writing. We will make reasonable efforts to resolve disputes amicably. You also retain the right to seek resolution through the Spanish consumer arbitration system or the relevant courts in Barcelona, España.
Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website and services provided by OptimaFusionTech, located at Carrer de Mallorca, 401, 08013 Barcelona, España. By accessing our website or engaging our services, you agree to be bound by these Terms.
1. Services
OptimaFusionTech provides DevOps consulting, CI/CD pipeline automation, infrastructure deployment, and related technical services. Service details, scope, and deliverables are specified in individual statements of work or service agreements.
2. Client Obligations
- Provide accurate and complete information necessary for service delivery.
- Grant timely access to relevant systems, repositories, and infrastructure.
- Designate a primary point of contact for project coordination.
- Review and approve deliverables within the agreed review periods.
- Make payments in accordance with the agreed payment schedule.
3. Payment Terms
Payment terms are specified in each individual service agreement. Unless otherwise agreed:
- Invoices are payable within 14 days of receipt.
- Late payments may incur a surcharge of 1.5% per month on the outstanding balance.
- All prices are quoted in Euros (€) and are exclusive of applicable taxes (VAT/IVA).
4. Intellectual Property
Upon full payment, all deliverables, code, configurations, and documentation produced specifically for the client under a service agreement shall be assigned to the client. OptimaFusionTech retains ownership of pre-existing tools, frameworks, libraries, and methodologies used in service delivery.
5. Confidentiality
Both parties agree to maintain the confidentiality of proprietary information exchanged during the engagement. Neither party shall disclose confidential information to third parties without prior written consent, except as required by law.
6. Limitation of Liability
To the maximum extent permitted by applicable law, OptimaFusionTech's total aggregate liability under any service agreement shall not exceed the total fees paid by the client for the specific service giving rise to the claim. We shall not be liable for indirect, incidental, consequential, or punitive damages.
7. Termination
Either party may terminate a service agreement with 30 days' written notice. In the event of termination, the client shall pay for all work completed up to the date of termination. Materials and deliverables completed shall be handed over to the client.
8. Force Majeure
Neither party shall be liable for any delay or failure in performance resulting from causes beyond reasonable control, including but not limited to natural disasters, pandemics, war, government actions, internet outages, or third-party service failures.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of Spain. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Barcelona, España.
10. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to this page. Continued use of our services after changes constitutes acceptance of the revised Terms.
